Terms of service

Effective 2026-09-08 · Draft pending counsel review. Applies to the CHERT Repatriation Platform at app.chertrepat.com. The Server edition is governed by its licence (AGPL-3.0 or a CHERT commercial licence).

1. The service

CHERT provides a hosted control plane that orchestrates migrations of mail tenants, stores and servers from cloud providers to a destination you control. You install and operate the destination and its agent; CHERT does not host your content.

2. Your responsibilities

  • You confirm you are authorised to migrate the source tenant, store or server, and that you have obtained any consents your users or your law require.
  • You keep the source intact until you separately approve decommissioning. The service will not delete or modify source data for you.
  • You review the verification report before cutover. Cutover is your decision; CHERT executes it on your instruction.
  • You keep your account credentials secure and enable multi-factor authentication.

3. Fees

Platform fees are charged per mailbox, server or store migrated, at the prices shown at the time you approve the migration plan, and are invoiced at job close. MSP tiers are agreed in writing.

4. Availability

CHERT targets 99.9% monthly availability of the control plane. Migrations in flight resume automatically after any interruption. Provider-side throttling and quota limits are outside CHERT's control and extend migration time without liability.

5. Data

Data handling is described in the privacy policy, which forms part of these terms.

6. Liability

To the extent permitted by law, CHERT's total liability under these terms is limited to the fees paid for the migration job concerned, and CHERT is not liable for indirect or consequential loss. Nothing limits liability for fraud, wilful misconduct, or where the law does not allow limitation.

7. Termination

You may close your account at any time from the console. CHERT may suspend an account for non-payment or misuse after notice. Migrations in progress are completed or rolled back at your election before closure.
